6. Linen and Natural Fabric Disclaimer
Fondea Studios products may include linen or linen-blend fabrics.
Linen is a natural fibre. Natural variations in weave, slubbing, texture, softness, colour tone and appearance are part of the character of linen and do not constitute faults or defects.
Due to the nature of linen and natural fabrics:
  • slight irregularities may be visible;
  • fabric may soften with wear and washing;
  • creasing is expected;
  • colour tone may vary slightly between batches;
  • texture may vary between garments;
  • shrinkage may occur if care instructions are not followed.
You are responsible for reading and following all garment care labels and care instructions.
We are not responsible for damage caused by incorrect washing, drying, ironing, steaming, bleaching, stain treatment, storage, wear or misuse.
7. Sizing and Fit
Our size guide is provided to help customers choose the most suitable size. It does not guarantee a perfect fit.
You are responsible for checking the size guide before ordering.
Measurements may vary slightly due to:
  • fabric behaviour;
  • production tolerances;
  • garment finishing;
  • measuring method;
  • natural movement of linen and woven fabrics.
A minor measurement variation will not usually be treated as a product fault.
8. Prices
All prices are shown in GBP sterling unless stated otherwise.
Prices include UK VAT where applicable, but exclude delivery charges unless expressly stated.
Delivery charges will be shown at checkout before you place your order.
We may change prices at any time. Price changes will not affect orders that we have already accepted, except where there has been an obvious pricing error.
9. Pricing Errors
We take care to ensure prices are accurate. However, errors may occur.
If a product is incorrectly priced, we may:
  • reject or cancel the order;
  • contact you for instructions;
  • refund any amount already paid;
  • require the return of goods supplied where the pricing error was obvious and unmistakable and could reasonably have been recognised as an error.
We are not obliged to supply a product at an incorrect lower price where the error is obvious or reasonably recognisable.
10. Payment
Payment must be made using one of the payment methods available at checkout.
Your payment may be processed by third-party payment providers, such as Shopify Payments, Stripe, PayPal, Klarna, Clearpay or other providers we may make available from time to time.
We do not store your full payment card details.
By placing an order, you confirm that:
  • you are authorised to use the payment method provided;
  • the billing information supplied is accurate;
  • sufficient funds or credit are available;
  • you will not make fraudulent chargebacks or payment disputes.
If your payment is refused, reversed, charged back or flagged as suspicious, we may cancel your order or suspend fulfilment.
11. Order Process
After placing an order, you may receive an email acknowledging receipt of your order.
This acknowledgement does not mean your order has been accepted.
Your order is an offer to purchase products from us. We accept your order only when we send you a dispatch confirmation or otherwise confirm that your order has been fulfilled.
A contract between you and us is formed only when we accept your order.
The contract will only apply to the products confirmed in the dispatch confirmation. If your order contains multiple products, each product may be accepted separately.
12. Right to Refuse or Cancel Orders
We reserve the right to refuse, cancel or limit any order at our discretion, including where:
  • the product is unavailable;
  • there is a pricing or product description error;
  • payment has not been authorised;
  • fraud or suspicious activity is suspected;
  • delivery information is incomplete or inaccurate;
  • you fail to provide information reasonably required by us;
  • we believe the order is for unauthorised resale;
  • there is abuse of promotions, discount codes or returns;
  • you have previously breached these Terms;
  • we are unable to fulfil the order due to circumstances outside our control.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item, unless we are legally entitled to withhold or deduct any amount.
We will not be liable for any loss, inconvenience, disappointment or cost arising from order refusal or cancellation, except where required by law.
13. Stock Availability
All products are subject to availability.
We may sell limited quantities or limited edition releases. Adding a product to your basket does not reserve it.
If an item becomes unavailable after you place an order, we may cancel the affected item and refund you.
14. Pre-Orders
We may offer pre-order items from time to time.
Pre-order delivery dates are estimates only and may change due to production, shipping, customs, supplier or operational delays.
If you purchase a pre-order item:
  • payment may be taken at the time of order;
  • your order may be dispatched later than standard items;
  • items ordered with pre-order products may be shipped together or separately;
  • you will be informed of material delays where reasonably possible.
You may cancel a pre-order before dispatch unless the item is personalised, custom-made or otherwise excluded by law.
15. Delivery
We currently sell online only.
Delivery options, estimated delivery times and costs will be shown at checkout or in our Shipping Policy.
Delivery estimates are not guarantees.
We are not responsible for delays caused by:
  • courier disruption;
  • customs checks;
  • strikes;
  • incorrect delivery information;
  • failed delivery attempts;
  • weather events;
  • public holidays;
  • high order volumes;
  • events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address.
If you provide an incorrect or incomplete address, you may be responsible for additional costs, failed delivery, re-delivery, return-to-sender charges or loss of the parcel.
16. Risk and Ownership
Risk in the products passes to you when the products are delivered to the address provided by you.
Ownership of the products passes to you only once we have received full payment for the products and all applicable delivery charges.
17. Failed, Refused or Unclaimed Deliveries
If a parcel is refused, unclaimed, undeliverable or returned to us because of customer error, we may deduct from any refund:
  • original delivery charges;
  • return shipping charges;
  • courier fees;
  • customs charges;
  • handling or administrative costs reasonably incurred.
If a parcel is abandoned, destroyed or retained by a courier or customs authority due to your failure to accept delivery, provide information, pay applicable charges or collect the parcel, we may be unable to refund you.
18. International Orders, Customs and Duties
If we offer international shipping, your order may be subject to import duties, taxes, customs fees, clearance charges or local administrative fees.
You are responsible for paying all such charges.
We do not control these charges and cannot predict their amount.
You are responsible for complying with the laws and regulations of the country to which the products are delivered.
We are not liable for delays, non-delivery, seizure or additional costs caused by customs or local import requirements.
19. Your Legal Right to Cancel
If you are a UK consumer buying online, you usually have a legal right to cancel your order within 14 days of receiving the goods, unless an exception applies.
To exercise your right to cancel, you must notify us clearly by email at:

Please include:
  • your name;
  • order number;
  • delivery address;
  • email address used for the order;
  • the item(s) you wish to return.
You then have a further 14 days to return the goods to us.
You are responsible for return postage costs unless the item is faulty or we have stated otherwise.
This does not affect your statutory rights.
20. Returns and Refunds
Our Returns & Refunds Policy forms part of these Terms.
Returned products must be:
  • new;
  • unworn;
  • unused;
  • unwashed;
  • unmarked;
  • unsoiled;
  • undamaged;
  • free from odour, perfume, deodorant, make-up, fake tan, pet hair or other marks;
  • returned with all tags, labels, hygiene seals, packaging, garment bags and accessories intact;
  • returned in suitable protective packaging.
We reserve the right to inspect all returns.
If a return does not meet our conditions, we may:
  • reject the return;
  • refuse a refund;
  • deduct an amount for loss in value;
  • return the item to you;
  • charge you for return shipping.
Refunds will usually be made to the original payment method.
We may withhold a refund until we have received the returned goods or you have provided evidence of return.
21. Sale Items and Promotions
Where legally permitted, sale items, archive sale items, final sale items, sample sale items, personalised items or items clearly marked as non-returnable may be excluded from discretionary returns.
This does not affect your statutory rights where an item is faulty, misdescribed or not of satisfactory quality.
Discount codes:
  • must be used at checkout;
  • cannot be applied retrospectively;
  • may be subject to expiry dates;
  • cannot usually be combined with other promotions;
  • may exclude sale items, gift cards, delivery charges or certain products;
  • may be withdrawn or amended at any time.
We reserve the right to cancel orders where a discount code is misused, shared unlawfully, exploited through technical error or used contrary to its terms.
22. Faulty or Misdescribed Products
We are under a legal duty to supply products that conform to the contract.
Nothing in these Terms affects your statutory rights.

Damage caused by normal wear and tear, misuse, accidental damage, failure to follow care instructions or improper washing will not usually be treated as a fault.
23. Personalised, Custom or Made-to-Order Items
Personalised, customised, altered, made-to-order or bespoke items cannot usually be cancelled, returned or refunded unless they are faulty or misdescribed.
This may include products with initials, embroidery, special alterations, custom sizing or other personalised features.
24. Gift Cards
If we offer gift cards, the following terms apply unless separate gift card terms are provided:
  • gift cards are valid for the period stated at purchase;
  • gift cards cannot be exchanged for cash;
  • gift cards cannot be replaced if lost, stolen or used without permission;
  • gift cards may only be used on our website unless stated otherwise;
  • if an order paid by gift card is refunded, the refund may be returned to the gift card;
  • we may cancel a gift card if fraud, misuse or error is suspected.
25. Accounts
You may be able to create an account on our website.
You are responsible for:
  • keeping your login details confidential;
  • ensuring your account information is accurate;
  • all activity under your account.
We may suspend or close accounts where we suspect fraud, misuse, breach of these Terms or security risk.

You may view and print website pages for personal, non-commercial use only.
Nothing in these Terms grants you any rights in our intellectual property.
30. Designs and Product Copying
You must not copy, reproduce, photograph, reverse engineer, manufacture, commission, sell or distribute products, designs, patterns, samples or visual representations of Fondea Studios products for commercial purposes.
We reserve all rights to protect our designs, branding and creative work.
31. User-Generated Content
If you tag, mention, message, submit, upload or share content featuring Fondea Studios, our products or our brand, including through Instagram, TikTok, Pinterest, Facebook, reviews, email or other platforms, you grant us a worldwide, royalty-free, non-exclusive licence to use, repost, share, reproduce, edit, crop, publish and display that content for marketing, advertising, website, social media, email and promotional purposes.
This may include your name, username, image, likeness, caption, review, photograph, video or styling content.
You confirm that:
  • you own or have permission to share the content;
  • the content does not infringe anyone else’s rights;
  • the content is not misleading, offensive or unlawful.
If you want us to stop using your content, please contact us at customerservices@fondeastudios.com and we will review your request.
32. Reviews and Customer Submissions
If you submit a review, comment, testimonial, image or other material, you agree that we may use it for marketing and promotional purposes.
We may moderate, edit, refuse or remove reviews or submissions that are offensive, misleading, defamatory, unlawful, irrelevant, fake, promotional or otherwise inappropriate.
You must not submit false reviews or content that infringes the rights of others.
33. Influencer, Creator and Affiliate Content
Any influencer, creator, affiliate or third-party content featuring Fondea Studios must comply with applicable advertising, disclosure and consumer protection rules.
